You understand and acknowledge that EasyMarry(EM) acts as an "Intermediary" as defined under clause (1) sub-clause (w) of Section 2 of the Information Technology Act, 2000. EM is a brand owned by Infenia Private Limited which owns, retains and has complete rights in EM and the EM Website /App/ EM Services.

EM serves as a platform that allows users to register independently by completing the required and any optional fields. This enables them to voluntarily explore profiles from EM's database of registered users in search of potential lawful matrimonial alliances. Members of EM are granted both free and paid access to search profiles based on their specified partner preferences through the website or applications. Additionally, users can shortlist profiles, express interest, and request to share details with those profiles that capture their attention.

To access any EM Services, it is necessary to register as a member on the Website or mobile applications (collectively referred to as the "Site"). This Agreement serves as an electronic contract that outlines the legally binding terms you must agree to in order to utilize the Site and attain the status of a "Member." In this context, the term "Member" refers to an individual who willingly provides information to the Site, regardless of whether they are utilizing the Service as a free or paid member. The term "User" denotes an individual who actively engages with the Site to promote their profile for matchmaking purposes.

By using the Site, you agree to be bound by these Terms of Use ("Agreement"). If you wish to become a Member and promote/advertise your profile to other Members and make use of the EM service ("Service"), read these Terms of Use and follow the instructions in the registration process.

By utilizing the Service, you agree to provide your personally identifiable information, which may include sensitive personal data such as financial information if you choose our paid membership, and identity verification documents if submitted. This information will be collected, processed, displayed, and utilized to deliver the Service and facilitate communication with other Members. If you have any concerns regarding the collection or processing of your personal data, we recommend that you refrain from registering on our Site.

If you wish to withdraw your consent or have any concerns about the continued collection or retention of your personal information, you must stop using our Service and delete your account. To delete your personal information and there by cancelling your account, please send an email from your registered email address to info@easymarry.in, as we cannot provide you with any of our Service without your personally identifiable information.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

  To become a Member of EM or to utilize this Site, you must possess legal capacity and meet the legal marriageable age requirements as stipulated by Indian law, which currently mandates that individuals be at least 18 years old for females and 21 years old for males.

  EM Membership and rights of admission is reserved solely for:

  Further in capacity as EM member you confirm that:

  If you have applied for Divorce, you must register on our website/App by stating "Awaiting Divorce".

  If you are a resident of any other Country, you are legally competent to marry as per the local rules applicable to your country and you shall comply with the Indian laws for marrying a person of Indian Origin.

  EM serves solely to assist in personal advertisements for legitimate marriage alliances between individuals who possess the legal capacity to marry according to the applicable laws. Membership in the Service is null and void where such participation is prohibited.

  By utilizing the EM Service, you affirm and guarantee that you possess the necessary rights, consent, authority, and legal capacity to engage in this Agreement; provide pertinent information to us; and that no existing law, order, decree, or injunction from any court, tribunal, or competent authority restricts you from entering into marriage.

  You further affirm your intention to seek a life partner and acknowledge that you will not utilize this site for casual dating or any commercial purposes. Additionally, you agree to adhere to all terms and conditions outlined in this Agreement and to use the service in compliance with all relevant laws. Should EM, at any time and at its sole discretion, determine that you are ineligible for membership, or if there is any reason to believe you have misrepresented yourself or violated any provisions of the Terms of Use or applicable laws, EM reserves the right to immediately terminate your membership and/or your access to the Service, without any refund for any unused subscription fees.

  By using this EM, you acknowledge that the match search results displayed by the system are based on the partner preference information you have included in your profile.

  EM retains the authority to disclose information to third parties concerning promotions or offers that are exclusive to our members.

Our Intellectual Properties

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties around the world.

The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only.

Your use of our Services

Subject to your compliance with these Legal Terms, including the "PROHIBITED ACTIVITIES" section below, we grant you a non-exclusive, non-transferable, revocable license to:

Your submissions and contributions

If we remove or edit any such Contributions, we may also suspend or disable your account and report you to the authorities.

Copyright infringement

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please immediately refer to the "COPYRIGHT INFRINGEMENTS" section below.

By using the Services, you represent and warrant that:

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

We expect that you would complete the online registration process with fairness and honesty in furnishing true, accurate, current, complete information and with providing recent photos of you which will help you to meet your parameters .We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photo. You are requested not to key in details of the profile in fields other than the applicable fields (including mentioning id's of other platforms/websites/App or repeating your details in other fields, after filling them once in the relevant fields or others photographs. In order to serve you better if EM requires additional details you agree to provide it.

If at any point of time EM comes to know or is so informed by third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete, EM shall have full right to suspend or terminate (without any notice) your EM membership and forfeit any amount paid by you towards EM membership fee and refuse to provide EM service to you thereafter.

EM also reserves the right to block the registration of your profile on Website/App, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered by the EM members in their profile.

Registration of duplicate profiles of the same person is not allowed in EM Website/App. EM shall have full right to suspend or terminate (without any notice) such duplicate profile.

You acknowledge and confirm that your registration with EM and the usage of EM services is with the genuine intention of marriage and not otherwise. EM Membership is restricted strictly to the registered EM individual member only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of EM and nor use the EM Service or EM members data for any commercial purpose, and EM reserves its right to initiate appropriate legal action for breach of these obligations.

You are responsible for safeguarding the confidentiality of your EM login credentials such as your user id, password, OTP, etc., and for restricting access to your computer/mobile to prevent unauthorized access to your account. We, as a Company, do not ask for Passwords and you are cautioned not to share your password to any persons. You agree to accept responsibility for all activities that occur under your account.

  EM reproduces your details once you register on our website /App on "as is as available" basis and also share your profile with other registered EM members within the website(s) of Infenia Private Limited.
• •
  EM's obligation is only to provide an interface to its registered members to search their prospects themselves without any assistance.
• •
  The profile search conducted by any EM member and the matches shown thereof are automatically generated by EM, and based on the partner preference set by you. In the event of EM members changing their partner preference on the Website/App, then the automated system generated prospect results of the Website/App may also undergo corresponding change.
• •
  EM does not prohibit any EM member from sending interest to your profile or communicating to you based on their partner preference. But you are at the liberty to deny their interest or proceed further if you are interested.
• •
  EM cannot guarantee or assume responsibility for any specific results from the use of the data available from the EM service or from other websites owned by Infenia Private Limited including community based websites.
• •
  EM shall safeguard sensitive user information using security standards, authentication mechanisms, access controls and encryption techniques.
• •
  EM cannot guarantee the complete protection of user data while it is in transit, or prevent any tampering of the data by a third party with malicious intent before the data reaches the EM servers.
• •
  EM do not authenticate/endorse any information of any profile and hence you as a user need to verify the credentials and information provided by other users.

  You shall safeguard your profile information by creating a strong password during profile creation with a combination of alphabets, both upper and lower case and numbers.
• •
  Any information / data required by EM for using the EM services shall be provided by the EM Member, as and when so sought by BM.
• •
  You are requested to verify the details of the prospect, exercise due care and caution regarding their profile information which includes marital status, educational qualifications, financial status, occupation, character, health status, etc. and satisfy yourself before making a choice of your match. EM shall not be liable for shortcoming due to any misrepresentations made by any of its EM members.
• •
  To get better search results, EM Members are expected to provide the latest photograph which should not be more than 3 (three) months old. Providing old photographs/ photographs of others, inaccurate / false information shall be treated as violation of terms and conditions.
• •
  EM members are expected to disclose their health records during profile enrollment which includes any pre-existing illness, physical disability etc. Non - disclosure at the time of enrollment shall be treated as violation of the terms and conditions.

  EM Members are advised to refrain from :

    Entering into any financial transactions with prospects. EM Members shall not seek financial help or provide financial help from / to the other EM Members
  • •
    Using abusive language when they communicate with the other EM Members
  • •
    Being discriminative or using racial comments etc.
  • •
    Sharing of confidential and personal data with each other but not limited to sharing of bank details, etc.
  • •
    Entering into a physical relationship with any prospect before marriage.
  • •
    Violating any law for the time being in force.
  • •
    From mentioning details of other matrimonial services while sending personalized messages
• •
  EM members are expected to visit URL https://www.easymarry.in/emwa/safety for understanding the safety measures on partner search and awareness towards online safety.
• •
  EM Members are expected to be cautious of prospects who ask for favours, money etc or call from multiple phone numbers, only interact over phone, don't come forward for face to face meetings (physically or through video calls) and don't involve family and friends in match making. Beware of suspended profiles status before you finalize an alliance with the prospect.
• •
  The EM members agrees that for getting effective search results of prospects on Website/App you will regularly log in to the profile maintained in the Website/App and send expression of interest which is an automated messages to prospects as a free EM member, and in the event you have availed paid EM package, you can utilize the additional feature which we are providing to the paid EM members based on the package you have availed. EM members also may review the expression of interest sent to you / read the messages sent to you by prospects and may respond suitably.

  You also agree that while accessing / using the Website/App, you will be guided by the terms and conditions of the Website/App including but not limited to the use of feature of website /App like chat instantly with prospect, viewing horoscope of prospects, enhancing privacy settings (photo/horoscope/phone number) or for viewing social and professional profile of members on their Facebook, LinkedIn, etc.

  If the EM Member fails to update in EM website/App, any change in the particulars furnished in their profile/ then the EM membership may be suspended by EM at its sole discretion.
• •
  EM members shall, in case of finalization of his/her/their Registrant's marriage, update their profile's marital status to Married by themselves. If the EM member intends to delete their profile then they have to intimate EM for removal/deletion of their profile through the email address registered with EM.
• •
  EM Members agree to use secure devices, software and networks in a private place for accessing the EM services.
• •
  EM members shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate or respond in EM Website/App.
• •
  EM Members shall not probe, scan or test the vulnerabilities of the EM Website/App or any network connected to the Website/App nor breach the security measures instituted by EM.
• •
  You shall also not make any payment / transfer any amount to the account of any employees of Infenia Private Limited. All payments shall be made only to the EM account.
• •
  EM members are expected to approach Infenia Private Limited to resolve their complaints and grievances and shall not post their grievances/complaints in social media.

in accordance with the prevailing RBI guidelines. The activation of the paid EM service is contingent upon the successful completion of the specified payment. Should a cheque or demand draft be dishonored, you will be responsible for any applicable bank charges associated with the bouncing of the cheque or demand draft. Additionally, the EM service linked to your account will be deactivated or suspended until you have paid the outstanding amount along with any relevant bank fees in cash.

EM employs third-party payment gateways to enable the collection of payments through credit or debit cards, along with various other payment options. If you choose any paid package from Infenia Private Limited priced at Rs. 2,00,000/- [Rupees Two Lakh Only] or higher, you consent to furnish us with your Permanent Account Number or Form 60/61, in compliance with the Income Tax Act of 1961 and its relevant regulations.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Taxes will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in Indian Rupee.

You agree to pay all charges at the prices then in effect for your purchases and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any payment placed through the Services. We may, in our sole discretion, limit or cancel payments that appear to be purchased per person, per household, or per order. These restrictions may include payments that appear to be placed by or under the same customer account, the same payment method, and/or orders that use the same billing address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

EM offers both Free and Paid packages, each designed to cater to different user preferences and levels of service. Details of the packages, including features, duration, and pricing, are displayed on our application or website and may be revised from time to time.

  You can cancel auto-renewal at any time through your account settings if applicable.

As a user of the Services, you agree not to:

The registration of EM membership and all EM services are deemed to have been entered into within the territorial Jurisdiction of Aluva, Kerala, India. The EM Members hereby agree without reservation that any disputes or differences that may arise shall be governed by the laws of India, and they submit to the exclusive jurisdiction of the appropriate court located in Aluva, Kerala, India.

You acknowledge and agree that you will not initiate or take part in any class action or similar collective legal proceeding regarding any disputes with EM. Additionally, neither you nor EM consents to class arbitration.

You agree to irrevocably submit all disputes related to these Legal Terms or the legal relationship established by these Legal Terms to the jurisdiction of the India courts. Infenia Private Limited shall also maintain the right to bring proceedings as to the substance of the matter in the courts of the country where you reside or, if these Legal Terms are entered into in the course of your trade or profession, the state of your principal place of business.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties set forth in these Legal Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the Services with whom you connected via the Services. EM by its automatic system sends to its member (s) profile (s) of the prospect by way of images/ documents/ messages / links. EM member confirms that the mobile number submitted to it for verification or alternative number if any provided, is not registered with the Do Not Disturb / National Customer Preference Register and they shall not initiate any complaint. EM Member further confirms that even if EM Member is registered with the telecom service provider under the category Do Not Disturb / National Customer Preference Register the calls from EM either to the verified mobile number or alternative number if any provided shall not be treated as promotional calls.

These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. The Grievance office shall be available between 10 am till 6 pm Indian Standard Time from Monday to Saturday excluding Personal Leaves, Sunday and public holidays in India. EM Members bear full responsibility for all communications, regardless of the medium, with prospects or vice versa. EM explicitly disclaims any responsibility or liability for any financial transactions, exchanges, interactions, or information sharing that occurs between EM members through email, chat, WhatsApp, or any other communication channels, whether via the website, app, or otherwise.
EM is not obligated to manage any conflicts that may occur between the EM members, and EM will not participate in any such disputes or legal proceedings.
EM does not act as a broker or represent any member of EM, nor does it engage in any discussions between EM members and potential members, or in the outcomes of such discussions.
